1. General Information
Welcome to Ecstatic Silence.
These Terms and Conditions govern access to and purchases made through www.ecstaticsilence.com, an online store operated by:

Ecstatic Silence Corp. is a company legally incorporated and domiciled in the Republic of Panama.
Certain physical products may be prepared and shipped from Peru through suppliers or logistics partners. Digital products may be sold and delivered to customers in different countries.
By making a purchase, the customer accepts these Terms and Conditions, without prejudice to any mandatory rights afforded to them under applicable law.
2. Products Offered
Ecstatic Silence sells a selection of products inspired by the Amazon, nature, and the cultural and creative expressions associated with it.
Our categories may include:
- Cacao and cacao-derived products.
- Botanical oils and other plant-based products.
- Fashion, textiles, accessories, and handcrafted items.
- Digital products, including meditations, audio recordings, rainforest sounds, e-books, and other downloadable or electronically accessible content.
The availability, presentation, composition, and characteristics of each product are described on its respective product page.
We reserve the right to modify our catalog, introduce new products, or withdraw items from sale.
3. Product Information and Presentation
We endeavor to ensure that product descriptions, photographs, prices, and other characteristics are clear and accurate.
However, slight variations in color, texture, shape, or finish may exist between images and physical products, particularly for items made from natural materials or through artisanal processes.
These variations do not exclude consumers' rights when a product does not match the characteristics offered or is defective.
Customers should review the description, contents, quantity, instructions for use, and available warnings before making a purchase.
4. Availability and Sales Regions
Product availability and delivery destinations may vary according to product category, logistical conditions, and applicable legal requirements.
Cacao: currently available for delivery within Peru.
Botanical oils: initially available for delivery within Peru. Distribution may expand to other countries in South and Central America.
Fashion and accessories: international availability may gradually expand, including to countries in North America, Europe, and other regions.
Digital products: may be purchased from different countries, provided that the payment method, technical conditions, and applicable law permit it.
The destinations actually available for an order will be displayed during checkout.
Ecstatic Silence does not guarantee delivery to countries or regions that are not enabled in the store.
5. Prices and Currency
Product prices are displayed in the currency indicated in the store and during checkout.
For sales currently made in Peru, prices may be displayed in Peruvian soles (PEN).
If international sales are enabled, the displayed currency and amounts charged may depend on the market, Shopify configuration, and available payment methods.
Applicable taxes, shipping costs, and other mandatory charges will be disclosed in accordance with the relevant legislation before the purchase is confirmed.
If a transaction involves currency conversion, the payment provider or the customer's financial institution may apply its own exchange rate or fees, subject to its terms.
We reserve the right to change prices for future purchases. Changes will not affect orders already accepted, except for corrections permitted by applicable law.
6. Purchasing Process
To make a purchase, the customer must:
- Select the desired products.
- Review their description, price, and availability.
- Add the products to the cart.
- Provide the information necessary for the purchase and, where applicable, delivery.
- Select an available payment method.
- Review the order summary and confirm the purchase.
Once the order has been processed, the customer will receive confirmation through the communication channels enabled in the store.
Automatic acknowledgment of receipt of an order does not limit the parties' rights in cases of obvious errors, availability issues, or circumstances provided for by applicable law.
If we are unable to fulfill an order that has already been paid for, we will inform the customer and offer the appropriate solution or refund.
7. Payment Methods
Payments are processed through the methods enabled during checkout.
Ecstatic Silence uses dLocal Go for certain electronic payments.
The availability of cards, currencies, and payment methods may vary depending on the customer's country and the provider's conditions.
Transactions are subject to the authorization, verification, and security procedures of the relevant payment providers.
We do not guarantee approval of a transaction if it is declined by the card issuer, payment processor, or another participating entity.
8. Preparation and Shipping of Physical Products
Certain physical products are prepared and shipped from Peru.
Preparation and delivery times depend on product availability, destination, and logistics provider.
Shipping costs and available delivery options will be displayed during checkout or communicated before the order is confirmed, as applicable.
Stated delivery times are estimates unless a guaranteed delivery date is expressly provided.
If a significant delay occurs, we will endeavor to inform the customer and provide the remedies required by applicable law.
The customer is responsible for providing an accurate and sufficiently complete delivery address.
Responsibility for loss, damage, or non-delivery will be determined in accordance with consumer protection rules and other applicable legislation, without these terms limiting mandatory rights.
9. Delivery of Digital Products
Digital products may be delivered through:
- Download links.
- Email.
- Access to electronic content.
- Platforms or applications integrated with our store.
The delivery method will be indicated in the product description or during checkout.
Customers must provide a valid email address and have the devices, software, and connection needed to use the content, where these requirements have been disclosed.
Access or delivery times may vary depending on the product and service used.
If the customer does not receive the relevant access or encounters a technical problem, they may contact ecstaticsilenceshop@gmail.com for assistance.
Purchasing a digital product does not transfer copyright or other intellectual property rights in its content.
10. Exchanges, Returns, and Refunds
Ecstatic Silence does not offer voluntary exchanges, returns, or refunds due to a change of mind, personal preferences, or decisions made after purchase.
This policy applies to both physical and digital products.
For digital products, voluntary refunds are not offered once the content has been made available to the customer.
However, customers may request a remedy when:
- The product is defective or damaged.
- A product different from the one purchased has been delivered.
- The product does not match the essential characteristics offered.
- Digital content cannot be used due to a defect or problem attributable to the product or delivery service.
- Another circumstance grants the customer rights to repair, replacement, return, refund, or withdrawal under applicable law.
To submit a request, customers must contact ecstaticsilenceshop@gmail.com, providing their order number and a description of the problem.
We may request photographs or other information reasonably necessary to assess the issue.
No provision of these Terms and Conditions limits or excludes consumers' mandatory rights. Where applicable law establishes a right of withdrawal, return, or refund, that right takes precedence over our policy of not offering voluntary returns.

11. Natural Products and Usage Recommendations
Some of our products contain ingredients of natural origin and may exhibit variations inherent to their composition and production process.
Customers must read and follow the applicable instructions, warnings, storage conditions, and expiration or best-before dates.
Food products must be stored and consumed according to the instructions provided.
Botanical oils must be used exclusively in accordance with the intended use and specific instructions for each product.
Unless expressly stated and supported by the relevant authorization, our products are not presented as medicines or substitutes for medical treatment.
General information available on the website is descriptive and does not replace advice from healthcare professionals.
These provisions do not limit our legal responsibility for the safety, quality, or conformity of the products sold.
12. Intellectual Property and Digital Content
Texts, photographs, designs, graphic elements, recordings, digital materials, and other website content may be protected by copyright, trademarks, or other intellectual property rights.
Unless expressly stated otherwise, purchasing a digital product grants the customer a personal, non-exclusive, non-transferable license to use the content for its intended purpose.
Without the express authorization of the rights holder, the customer may not:
- Resell or redistribute the content.
- Publicly share files or restricted-access links.
- Reproduce or use the content for commercial purposes.
- Present the content as their own creation.
- Modify it or incorporate it into other products intended for sale.
These restrictions apply to the extent permitted by applicable law and without prejudice to legally authorized uses.
Rights in third-party works, recordings, or cultural expressions remain with their respective owners. The sale of content by Ecstatic Silence does not necessarily mean that the company owns all rights in that content.
13. Proper Use of the Website
Customers agree to use our store lawfully and respectfully.
The following are prohibited:
- Placing fraudulent orders.
- Using payment methods without authorization.
- Attempting unauthorized access to systems or accounts.
- Introducing malicious software or interfering with the website's operation.

15. Service Availability and Operation
We endeavor to keep our store accessible and functioning properly.
Nevertheless, temporary interruptions may occur due to maintenance, technical problems, or circumstances beyond our control.
Where an incident affects an order or a purchased digital product, we will endeavor to provide assistance and appropriate remedies.
Nothing in this section excludes liabilities that cannot legally be limited.
16. Liability
Ecstatic Silence is responsible for its contractual and legal obligations as established by applicable law.
To the extent permitted by law, we do not accept liability for damage arising exclusively from misuse of a product contrary to clear warnings and instructions.
However, no provision of these terms excludes or limits liability for defective products, contractual breaches, damage, or other circumstances in which the law prohibits limiting liability.
17. Taxes, Customs, and International Sales
When international delivery of physical products is enabled, import requirements, taxes, customs duties, and customs procedures may apply depending on the destination country.
The corresponding charges and responsibilities will be communicated in accordance with applicable law and the terms of sale disclosed before the order is confirmed.
International sales of digital products may also be subject to taxes or specific obligations depending on the buyer's jurisdiction.
Ecstatic Silence will apply the taxes and procedures legally required for the transactions carried out.
18. Extraordinary Circumstances
In the event of circumstances beyond our reasonable control that affect the preparation, transportation, or delivery of products, we will inform the customer whenever possible.
Such circumstances may include natural disasters, major transportation disruptions, restrictions imposed by authorities, or widespread failures of essential services.
The consequences for each order will be resolved in accordance with applicable law and without prejudice to consumers' mandatory rights.
19. Applicable Law and Consumer Rights
Ecstatic Silence Corp. is legally domiciled in the Republic of Panama.
Contractual relationships will be interpreted in accordance with the rules applicable to each transaction.
The company's domicile in Panama does not exclude the application of mandatory consumer protection, privacy, e-commerce, or other laws of the customer's country where legally applicable.
No clause of these Terms and Conditions deprives consumers of rights or complaint mechanisms that cannot be waived by contract.
20. Changes to the Terms and Conditions
We may amend these Terms and Conditions to reflect changes in our products, services, business processes, or legal requirements.
The updated version will be published on our website with its corresponding revision date.
Unless otherwise provided by law, amendments will not retroactively change the terms applicable to orders already concluded.
